These Terms govern access to and use of WellWaterClarity.com. By using the site, you agree to these Terms. If you do not agree, do not use the site.
Permitted use
Well Water Clarity grants you a limited, revocable, nonexclusive, nontransferable permission to access and use the site for lawful personal and educational purposes. No ownership rights are transferred.
Prohibited use
You may not use the site unlawfully; interfere with its operation or security; introduce malware; attempt unauthorized access; impersonate another person; infringe rights; remove notices; use automated means that impose an unreasonable burden; or copy, republish, sell, or commercially exploit protected content except with permission or as allowed by law.
Educational information and no professional relationship
The site provides general educational information about private wells and water treatment. It is not medical, toxicological, laboratory, engineering, plumbing, electrical, environmental, legal, or other professional advice. Use does not create a professional-client, fiduciary, advisory, contractor, laboratory, or similar relationship.
Do not rely on the site to determine whether water is safe, identify a contaminant, prescribe treatment, size equipment, perform repairs, or respond to an emergency. Use appropriately certified laboratories, current government guidance, and qualified local professionals.
Symptom Finder and tools
Interactive tools organize observations and questions. They are educational aids, not diagnoses, inspections, calculations certified for a specific property, or guarantees of safety or treatment suitability. You are responsible for verifying inputs and results.
Third-party content, products, and links
The site may link to government agencies, laboratories, merchants, manufacturers, service providers, and other third parties. We do not control their content, availability, security, prices, claims, products, services, or privacy practices. A link does not guarantee endorsement or suitability. Verify current information directly with the responsible source.
Affiliate relationships
Some links may be affiliate links. We may receive compensation if a visitor makes a qualifying purchase or takes another covered action. See the Affiliate Disclosure. Compensation does not replace independent testing, certification checks, professional sizing, installation review, or maintenance planning.
Intellectual property
Original site text, artwork, branding, page design, and code are owned by or licensed to Well Water Clarity unless otherwise identified. They are protected by applicable intellectual-property law. Third-party names and materials remain the property of their owners. See the Copyright and Permissions Policy.
Site changes and availability
We may correct, update, suspend, restrict, or discontinue any part of the site without promising continued availability. Content may become outdated, incomplete, or unavailable.
Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, CURRENCY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT WATER SAFETY, PRODUCT PERFORMANCE, PROFESSIONAL RESULTS, OR THAT CONTENT WILL APPLY TO A PARTICULAR PROPERTY.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WELL WATER CLARITY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, BUSINESS, USE, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, CONTENT, TOOLS, LINKS, PRODUCTS, SERVICES, OR RELIANCE ON THEM, EVEN IF THE POSSIBILITY WAS ADVISED. TO THE FULLEST EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNT YOU PAID DIRECTLY TO WELL WATER CLARITY FOR THE SPECIFIC SITE SERVICE GIVING RISE TO THE CLAIM DURING THE PRECEDING TWELVE MONTHS.
Some jurisdictions do not allow certain exclusions or limitations. These provisions apply only to the extent allowed. Nothing excludes liability that cannot lawfully be excluded, including liability arising from fraud, willful misconduct, or other nonwaivable rights.
Indemnity for misuse
To the extent permitted by law, you agree to indemnify Well Water Clarity against third-party claims, damages, and reasonable costs arising from your unlawful misuse of the site, infringement of another person's rights, or material violation of these Terms. This does not require indemnity for ordinary reading or for conduct attributable to Well Water Clarity.
Governing law and forum
These Terms are governed by Oklahoma law, without regard to conflict-of-law principles, except where mandatory law provides otherwise. Subject to applicable jurisdictional and consumer-protection limits, disputes shall be brought in a state or federal court with jurisdiction in Oklahoma.
Changes to these Terms
We may update these Terms prospectively. The Last updated date will change. Material changes may also be announced on the site. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
General provisions
If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions continue. Failure to enforce a provision is not a waiver. Headings are for convenience. These Terms, together with policies expressly incorporated by reference, form the entire agreement concerning site use.
